NOTICE is hereby given that the Town Council, at an ordinary meeting that will be held behind closed doors via technological mean of communication, on Monday May 3, 2021, at 7h30 pm, will consider the request for minor exemption from the zoning By-Law 1156-11, presented by Mr Claude Berger, for the lot 4 469 266, cadastre du Québec.

The nature and consequences of this exemption are the following:

  • the nature of the minor exemption is to reduce of 6 m² the minimal area of a principal building in accordance to the minimal area of 50 m² required at the article 4.2 of the Zoning By-Law 1156-11;
  • the minor exemption will have for consequence to permit the construction of a principal building with an area of 44 m².

Written consultation

Act respecting land use and development provides that any interested party may be heard by the municipal council when the latter must rule on a request for a minor exemption, but that currently, under ministerial order 2020-029 dated from April 26, 2020, the meetings of the municipal council can be held exceptionally behind closed doors during the state of health emergency;

By virtue of ministerial order 2020-049 dated July 4, 2020, any procedure other than a referendum which is part of the decision-making process of a municipal body and which involves the movement or gathering of citizens can be suspended if the council decides to replace the procedure with a 15 days written consultation announced beforehand by a public notice;

During the session of the municipal council which was held behind closed doors via technological mean of communication on April 6, 2021, the latter authorized, by resolution 21-04-048, the consultation in writing of the persons interested with regard to the request for minor exemption mentioned above in the minutes of the advisory planning committee, adopted by the town council by the resolution 21-04-048;

The municipal council, during the ordinary meeting to be held behind closed doors, Monday May 3, 2021, at 7:30 p.m., and broadcasted, via technological mean of communication, rule on this request for minor exemption;

  • the nature of the minor exemption is to reduce of 536.2 m2 the area of a building lot in accordance to the area of 1 400m2 required at the article 5.3 A) of the land division By-Law 1157-11.
  • the minor exemption will have for consequence to regularize the lot with an area of 863.8 m2.

ENACTMENT OF BY-LAW

1.-     THAT at a meeting held on March 1, 2021, the Town Council has adopted the following by-laws :

By-law 1156-11-49 : Règlement amendant le règlement de zonage 1156-11 en

By-law 1157-11-02 : Règlement amendant le règlement de lotissement 1157-11 en modifiant le titre du point C) de l’article 5.3 Normes particulières pour les habitations multifamiliales*, les projets intégrés* et les ensembles immobiliers*.

2.- THOSE by-laws 1156-11-49, 1170-12-04, 1171-12-03 and 1157-11-02 have been approved by the council of the regional county municipality La Côte-de-Gaspé, on March 10, 2021;

3.- THAT an assessment of conformity has been issued by the Secretary-treasurer of the regional county municipality La Côte-de-Gaspé in respect of those by-laws 1156-11-49, 1170-12-04, 1171-12-03 and 1157-11-02 on March 16, 2021;

4.- THOSE by-laws 1156-11-49, 1170-12-04, 1171-12-03 and 1157-11-02 came into force on March 16, 2021, according to the Act respecting land use planning and development;

PUBLIC NOTICE is hereby given by the undersigned, Clerk of Ville de Gaspé, that at a regular sitting held behind closed doors and by videoconference on March 1st, 2021, the Town Council has adopted the following By-Law:

1442-21 : RÈGLEMENT DÉCRÉTANT UNE DÉPENSE DE 1 334 353 $ ET UN EMPRUNT DE 1 149 115 $ POUR DES TRAVAUX DE CONSTRUCTION D’UNE PISTE CYCLABLE DANS LE SECTEUR DE RIVIÈRE-AU-RENARD

THAT by virtue of decrees 2020-033 of May 7, 2020 and 102-2021 of February 5, 2021, taken in the context of the health emergency declaration ordered by the government, any procedure for the registration of qualified voters applied under Chapter IV of Title II of the Act respecting elections and referendums in municipalities is replaced by a procedure for receiving written requests for a 15-day referendum poll.

THAT the persons qualified to vote on this By-Law on the date of March 1st, 2021, and who have therefore the right to demand that this By-Law be submitted to a referendum poll.  A demand must be done by writing and have the followings informations:

  • The By-law number or the By-law title who’s in the object of the demand;
  • The name, address and the capacity of the person qualified to vote, and with their signature.

It is possible to make a demand for a referendum poll by using the available form following this public notice.

This request must be accompanied with a copy of one of those following identity pieces : a health-insurance card issued by the Québec Health Insurance Board, a driver’s permit or a temporary permit issued by the Québec Automobile Insurance Society, a Canadian passport, an identity card of the Canadian armed forces, a certificate of Indian status.

In the case that the name of the person is not on the list of the qualified voters entitled to have their name entered on the referendum list of the entire municipality, the request must also be accompanied by a document attesting to his right to be registered there.

All person who assist another person qualified to vote who’s unable to sign by-herself the demand must register:

  • His name;
  • his relationship with the person qualified to vote (spouse, parent or other);
  • if the person entitled to vote is neither a parent nor a spouse, a written declaration that he did not assist another person who is not a parent or a spouse during the procedure referendum poll request;
  • a statement that she assisted the person qualified to vote;
  • his signature;

THAT the number of applications needed in order that a referendum poll be held for this By-Law is 1 211 and failing this number, the concerned By-Law will be deemed approved by the qualified voters.

THAT the result of this registration procedure will be publish at 9 am, on March 29, 2021 on the website of the city of Gaspé under the section of public notices.

IS A QUALIFIED VOTER OF THE MUNICIPALITY

A person who, on March 1st, 2021, is not disqualified from voting according to article 524 of the Act respecting elections and referendums in municipalities and meets the following requirements:

  • a natural person domiciled in the municipality and, since at least six months, in Québec and
  • is of full age and a Canadian citizen, and not under curatorship.

The non resident sole owner of an immoveable or non resident sole occupant of a business place situated in the municipality who is not disqualified from voting and meets the following requirements:

  • is the owner of an immoveable or sole occupant of a business place situated in the municipality since at least 12 months;
  • in the case of a natural person, be of full age and Canadian citizen and not under curatorship.

The non resident undivided co-owners and non resident co-occupants of a business place situated in the municipality not disqualified from voting and meet the following requirements:

  • is the undivided co-owner of an immoveable or co-occupant of a business place situated in the municipality since at least 12 months;
  • is designated by means of a power of attorney signed by a majority of the persons who are co-owners or co-occupants since at least 12 months, as the one who has the right to sing in their name and to be entered on the referendum list of the municipality. This power of attorney must be produced before or at the signature time.

Legal person:

  • have designated by resolution among its members, directors or employees, a person who, on March 1st, 2021, and at voting time, is of full age and Canadian citizen, is not under curatorship and is not disqualified to vote.

Second draft 1156-11-49 (adopted on February 15, 2021) amending the by-law 1156-11

NOTICE is hereby given that, following the writting consultation which was held from January 21 to February 5, 2021, the municipal Council of "Ville de Gaspé" has accepted by resolution, on February 15, 2021 a second draft of by-law 1156-11-49 amending the by-law 1156-11.  This second draft contains provisions that may be subject to an application made by interested persons from anyone of the zones to which such provisions apply and of the contiguous zones, to require that a by-law containing these be submitted for their approval, in accordance with the Act respecting elections and referendums in municipalities.

1.       PURPOSE OF AN APPLICATION TO TAKE PART TO A REFERENDUM

1.1     An application relating to the following provision of the second draft:

  • « Modifiant le premier paragraphe de l’article 4.1 NOMBRE PAR TERRAIN* »

Such an application is required that the by-law containing the provision to which it applies be submitted for the approval of the qualified voters in the zone to which applies this application, and in any contiguous zone from which a valid application originates. 2.       LOCALIZATION OF THE CONCERNED ZONES

These zones are located in the area of Douglastown, between the 33, avenue Matte and the 1335, boulevard de Douglas, and illustrated on the following sketch:568 99193

3.       VALIDITY OF AN APPLICATION

To be valid, an application to take part to a referendum must:

  • state clearly the provision of the second draft to which the application refers;
  • indicate the zone from which the application originates;
  • be signed by at least 12 interested persons of the zone from which it originates, if there are more than 21 interested persons in that zone, or, otherwise, by the majority of the interested persons;
  • be received by the Town clerk office at the town hall no later than February 26, 2021, 4:30 pm.

Given the current circumstances and in compliance with the guidelines for social distancing, the City replaces the usual procedure for the transmission of a form with that of the written request by inviting interested persons to individually forward a request to the director of legal services and town clerk at the following email address: greffe@ville.gaspe.qc.ca. This request must also contain a copy of the applicant's ID.

4.       INTERESTED PERSONS WHO ARE ENTITLED TO SIGN AN APPLICATION

An interested person is a person of full age, Canadian citizen and not under curatorship who, on the date of adoption of the second draft, which is February 15, 2021, is not disqualified from voting and meets one of the following requirements:

  • is domiciled in a zone from which an application may originate and who has been domiciled in Québec for at least 6 months;
  • is the owner of an immovable or the occupant of a business place situated on such a zone since 12 months at least.

5.       LACK OF APPLICATIONS

Should there be no valid applications relating to the provisions of the second draft, the said provisions may be then included in a by-law which will not have to be submitted for the approval of the qualified voters.

6.       CONSULTATION OF THE DRAFT

The second draft of by-law is available, in French, for consultation in the document also attached to this notice.

ATTENDU QUE la Ville de Gaspé a adopté le Règlement de zonage no 1156-11 dont font partie un plan de zonage et des grilles de « spécifications »;

ATTENDU QUE la Ville de Gaspé est régie par la Loi sur l’aménagement et l’urbanisme (L.R.Q., ch. A-19.1) et que le Règlement no 1156-11 ne peut être modifié que conformément aux dispositions de cette loi;

ATTENDU QUE suivant les directives de l’Arrêté ministériel numéro 2020-074 le ministre de la Santé et des Services sociaux du 2 octobre 2020 émis dans le cadre de la pandémie du coronavirus (COVID-19) qui stipule que toute procédure autre que référendaire qui fait partie du processus décisionnel d’un organisme municipal et qui implique le déplacement ou le rassemblement de citoyens peut être remplacée par une procédure de consultation écrite, l’assemblée publique de consultation sur le projet de règlement 1156-11-49 a donc été remplacée par une procédure de consultation écrite qui s’est tenue du 21 janvier 2021 au 5 février 2021;

            ATTENDU QU’aucun commentaire n’a été soumis pendant la période de consultation écrite;

ATTENDU QUE ce règlement contient des dispositions pouvant faire l’objet d’une demande de la part des personnes intéressées afin qu’elle soit soumis à leur approbation conformément à la Loi sur les élections et les référendums dans les municipalités (L.R.Q., c. E-2.2);

ATTENDU QU’un avis public aux personnes intéressées ayant le droit de signer une demande de participation à un référendum a été publié sur le site internet de la Ville de Gaspé, le

ATTENDU QU’un avis de motion de la présentation de ce règlement a régulièrement été donné à la séance régulière de ce conseil, tenue le 15 février 2021;

EN CONSÉQUENCE, il est proposé par

QU’un règlement de ce conseil, portant le numéro 1156-11-49, soit et est adopté et qu’il soit statué et décrété ce qui suit, à savoir :

ARTICLE 1 :   Le Règlement de zonage no 1156-11 est amendé en :

  • Modifiant le premier paragraphe de l’article 4.1 NOMBRE PAR TERRAIN* comme suit :

Sous réserve de dispositions particulières, un (1) seul bâtiment principal* peut être érigé sur un terrain*. Cette disposition ne s'applique toutefois pas aux bâtiments* d'habitation faisant partie d'un projet intégré*, aux géodômes*, aux installations aéroportuaires ainsi qu'aux usages* publics et institutionnels.

ARTICLE 2 :   Le Règlement de zonage no 1156-11 est amendé en :

  • Ajoutant un deuxième paragraphe à l’article 5.2 BATIMENTS* PROHIBES se lisant comme suit :

Nonobstant le paragraphe précédent, l’implantation de géodôme* est autorisée lorsqu’il est identifié comme usage spécifiquement permis, conformément à l’article 7.7 du Règlement de zonage no 1156-11.

ARTICLE 3 :   Le Règlement de zonage no 1156-11 est amendé en :

  • Ajoutant l’article 7.7 GEODOME* se lisant comme suit :

7.7    géodome*

Toute nouvelle implantation et tout agrandissement d’un usage* appartenant à l’usage* Géodôme* doit répondre au Règlement relatif aux plans d’implantation et d’intégration architectural (PIIA*) no 1171-12.

 

  • Les géodômes* sont autorisés uniquement sur des terrains* non desservis dans les zones* situées à l’extérieur des périmètres urbains* et des secteurs identifiés au Plan de zonage ainsi que dans les zones* où ils sont autorisés à la grille de spécifications comme un usage* spécifiquement permis ;
  • Le nombre de géodôme* autorisé varie d’un minimum de trois (3) à un maximum de six (6), et ce, en fonction de la superficie du terrain* tel que démontré au tableau suivant :

  • Le projet doit obligatoirement avoir un bâtiment* de service ayant une superficie au sol* minimale de cinquante mètres carrés (50 m2) ;
  • Les géodômes* doivent avoir une superficie au sol* minimale de trente mètres carrés (30 m2) et maximale de soixante mètres carrés (60 m2), et peuvent posséder un maximum d’un étage* ;
  • La distance séparant chaque géodôme* est fixée à un minimum de huit mètres (8 m) ;
  • Les marges de recul latérales* et arrière* sont fixées à un minimum de huit mètres (8 m) ;
  • Les marges de recul avant* prescrites à la grille de spécifications de la zone* concernée doivent être respectées sur chaque rue publique* ;
  • Le projet doit être conforme à la Loi sur la qualité de l’environnement (L.R.Q., c. Q‑2) et aux règlements édictés sous son emprise ;
  • Une bande boisée de cinq mètres (5 m), mesurée à partir de la ligne avant* est obligatoire. Cette bande boisée doit créer un écran tampon* continu (à l’exception de l’allée de circulation*) composé à quatre-vingts pour cent (80 %) de conifères (à l’exception du mélèze). La hauteur des arbres doit être d’un minimum d’un mètre quatre‑vingts (1,80 m) au début de l’usage*.

 

ARTICLE 4 :   Le Règlement de zonage no 1156-11 est amendé en :

  • Créant la zone PA-182-1 à même la zone PA-182;

Le tout tel qu’indiqué au plan préparé par Mélanie Roussy, inspectrice du service d’Urbanisme, de l’Aménagement du territoire et de l’Environnement, daté du 18 janvier 2021 et portant le numéro MR-18012021-PZ lequel est joint comme annexe «A».

ARTICLE 5 :   Le Règlement de zonage no 1156-11 est amendé en :

  • Ajoutant la grille de spécifications pour la zone PA-182-1;

Le tout tel qu’indiqué à la grille de spécifications, laquelle est jointe au présent règlement comme annexe «B».

ARTICLE 6 :   Le Règlement de zonage no 1156-11 est amendé en :

  • Créant la zone PA-182-2 à même la zone PA-182;

ARTICLE 9 :   Le présent règlement ainsi que ses annexes «A», «B» et «C» font partie intégrante du règlement de zonage qu’ils modifient.

ARTICLE 10 : Le présent règlement entre en vigueur conformément à la loi.

Second draft 1157-11-02 (adopted on February 15, 2021) amending the by-law 1157-11

NOTICE is hereby given that, following the writting consultation which was held from January 21 to February 5, 2021, the municipal Council of "Ville de Gaspé" has accepted by resolution, on February 15, 2021 a second draft of by-law 1157-11-02 amending the by-law 1157-11.  This second draft contains provisions that may be subject to an application made by interested persons from anyone of the town of Gaspe.

1.       PURPOSE OF AN APPLICATION TO TAKE PART TO A REFERENDUM

1.1     An application relating to the following provision of the second draft:

  • « Modifiant le titre du point C) de l’article 5.3 Normes particulières pour les habitations multifamiliales*, les projets intégrés* et les ensembles immobiliers*»

Such an application is required that the by-law containing the provision to which it applies be submitted for the approval of all the qualified voters of the town of Gaspe.

2.         LOCALIZATION OF THE CONCERNED ZONES

The concerned zones, situated in the Gaspé area, are illustrated on the following sketche :image 567 0b9c3

3.       VALIDITY OF AN APPLICATION

To be valid, an application to take part to a referendum must:

  • state clearly the provision of the second draft to which the application refers;
  • indicate the zone from which the application originates;
  • be signed by at least 12 interested persons of the zone from which it originates, if there are more than 21 interested persons in that zone, or, otherwise, by the majority of the interested persons;
  • be received by the Town clerk office at the town hall no later than February 26, 2021, 4:30 pm.

Given the current circumstances and in compliance with the guidelines for social distancing, the City replaces the usual procedure for the transmission of a form with that of the written request by inviting interested persons to individually forward a request to the director of legal services and town clerk at the following email address: greffe@ville.gaspe.qc.ca. This request must also contain a copy of the applicant's ID.

4.       INTERESTED PERSONS WHO ARE ENTITLED TO SIGN AN APPLICATION

An interested person is a person of full age, Canadian citizen and not under curatorship who, on the date of adoption of the second draft, which is February 15, 2021, is not disqualified from voting and meets one of the following requirements:

  • is domiciled in a zone from which an application may originate and who has been domiciled in Québec for at least 6 months;
  • is the owner of an immovable or the occupant of a business place situated on such a zone since 12 months at least.

5.       LACK OF APPLICATIONS

Should there be no valid applications relating to the provisions of the second draft, the said provisions may be then included in a by-law which will not have to be submitted for the approval of the qualified voters.

6.       CONSULTATION OF THE DRAFT

The second draft of by-law is available, in French, for consultation in the document also attached to this notice.

We recommend you to consult the Service de l’Urbanisme to verify in which area your building is situated.

  • Modifiant le titre du point C) de l’article 5.3 Normes particulières pour les habitations multifamiliales*, les projets intégrés* et les ensembles immobiliers*

ATTENDU QUE la Ville de Gaspé a adopté le Règlement de lotissement no 1157-11;

ATTENDU QUE la Ville de Gaspé est régie par la Loi sur l’aménagement et l’urbanisme (L.R.Q., ch. A-19.1) et que le Règlement no 1157-11 ne peut être modifié que conformément aux dispositions de cette loi;

ATTENDU QUE suivant les directives de l’Arrêté ministériel numéro 2020-074 le ministre de la Santé et des Services sociaux du 2 octobre 2020 émis dans le cadre de la pandémie du coronavirus (COVID-19) qui stipule que toute procédure autre que référendaire qui fait partie du processus décisionnel d’un organisme municipal et qui implique le déplacement ou le rassemblement de citoyens peut être remplacée par une procédure de consultation écrite, l’assemblée publique de consultation sur le projet de règlement 1157-11-02 a donc été remplacée par une procédure de consultation écrite qui s’est tenue du 21 janvier 2021 au 5 février 2021;

            ATTENDU QU’aucun commentaire n’a été soumis pendant la période de consultation écrite;

ATTENDU QUE ce règlement contient des dispositions pouvant faire l’objet d’une demande de la part des personnes intéressées afin qu’elle soit soumis à leur approbation conformément à la Loi sur les élections et les référendums dans les municipalités (L.R.Q., c. E-2.2);

ATTENDU QU’un avis public aux personnes intéressées ayant le droit de signer une demande de participation à un référendum a été publié sur le site internet de la Ville de Gaspé, le

ATTENDU QU’un avis de motion de la présentation de ce règlement a régulièrement été donné à la séance régulière de ce conseil, tenue le 15 février 2021;

EN CONSÉQUENCE, il est proposé par

QU’un règlement de ce conseil, portant le numéro 1157-11-02, soit et est adopté et qu’il soit statué et décrété ce qui suit, à savoir :
