1454-21 :   « RÈGLEMENT DÉCRÉTANT UNE DÉPENSE D’UNE SOMME DE 909 100 $ ET UN EMPRUNT D’UNE SOMME DE 909 100 $ POUR LA RÉALISATION DE TRAVAUX DE RÉFECTION DE LA RUE DES POMMIERS »

THAT the persons qualified to vote on the By-Law on the date of December 6, 2021, and who have therefore the right to demand that this By-Law be submitted to a referendum poll will have access to a register open for that purpose from nine (9) hours to nineteen (19) hours on December 13 and 14, 2021 at the office of the undersigned, at the Town Hall in order to enter their name, address and occupation together with their signature.

IS A QUALIFIED VOTER OF THE MUNICIPALITY

A person who, on December 6, 2021, is not disqualified from voting according to article 524 of the Act respecting elections and referendums in municipalities and meets the following requirements:

  • a natural person domiciled in the municipality and, since at least six months, in Québec and
  • is of full age and a Canadian citizen, and not under curatorship.

The non resident sole owner of an immoveable or non resident sole occupant of a business place situated in the municipality who is not disqualified from voting and meets the following requirements:

  • is the owner of an immoveable or sole occupant of a business place situated in the municipality since at least 12 months;
  • in the case of a natural person, be of full age and Canadian citizen and not under curatorship.

The non resident undivided co-owners and non resident co-occupants of a business place situated in the municipality not disqualified from voting and meet the following requirements:

  • is the undivided co-owner of an immoveable or co-occupant of a business place situated in the municipality since at least 12 months;
  • is designated by means of a power of attorney signed by a majority of the persons who are co-owners or co-occupants since at least 12 months, as the one who has the right to sing in their name and to be entered on the referendum list of the municipality. This power of attorney must be produced before or at the signature time.

Legal person:

  • have designated by resolution among its members, directors or employees, a person who, on December 6, 2021, and at voting time, is of full age and Canadian citizen, is not under curatorship and is not disqualified to vote.

THAT the persons qualified to vote on the By-Law in question must establish their identity to the responsible person for the register, by presenting, among others: a health-insurance card issued by the Québec Health Insurance Board, a driver’s permit issued by the Québec Automobile Insurance Society, a Canadian passport, an identity card of the Canadian armed forces, a certificate of Indian status.

THAT the number of applications needed in order that a referendum poll be held for this By-Law is 1 238 and failing this number, the concerned By-Law will be deemed approved by the qualified voters.

THAT the qualified voters may examine this By-Law at the office of the undersigned from 8 h 15 am till 12 h and from 1 h till 4 h 30 pm from Monday till Thursday, and from 8 h 15 am till 12 h on Friday, and during registration hours.

THAT the result of this registration procedure will be announced on December 14, 2021, at 7 pm, at the office of the undersigned, 25, rue de l’Hôtel-de-Ville in Gaspé.

Public notice is hereby given by the undersigned, returning officer, that:

  1. The municipal list of electors has been filed at the office of the municipality on October 5, 2021. It will now be revised.
  1. In order to vote, you must be entered on the list of electors.
  1. You have the right to be entered on the list of electors if:
  • You will be 18 years of age on polling day;
  • On September 1, 2021:
  • you had the Canadian citizenship;
  • you were not under curatorship;
  • you had not been convicted of a corrupt electoral practice in the previous five years;

 

  • In addition, you must meet one of the following two conditions on September 1, 2021:
    • Be domiciled on the territory of the municipality and for at least six months in Québec.
    • For at least 12 months, own an immovable or occupy a business establishment located on the territory of the municipality;

NOTE:   If you are not domiciled in the municipality and want to exercise your voting right, you will need to send an application for entry or a power of attorney, as the case may be, to the returning officer.

  1. You will be able to consult the list of electors and, if you are an elector domiciled in the municipality, submit an application for entry, striking or correction before the board of revisors at the following days and during the following hours at 25, rue de l’Hôtel-de-Ville:
  • October 20 from 10 a.m. to 1:30 p.m;
  • October 20 from 2:30 p.m. to 5:30 p.m.;

  1. For any application for entry of a person domiciled in the territory of the municipality, the person who applies must indicate the previous address of the person’s domicile and present two documents: one indicating the name and date of birth of the person and the other, his or her name and domicile address.
  1. You may submit a written application for entry, correction or striking from the list of electors to the returning officer if you are domiciled in the municipality and you are in one of the following situations:
  • You are domiciled or lodged in an eligible health establishment;
  • You are unable to travel for health reasons or you are a caregiver domiciled at the same address as such a person.
  • You will be 70 years of age or older on polling day.
  • You must comply with an order or recommendation for isolation from public health authorities because you:
  • returned from a trip abroad within the last 14 days;
  • were diagnosed with COVID-19 and you are still considered a carrier of the disease;
  • are showing COVID-19 symptoms;
  • have been in contact with a suspected, probable or confirmed case of COVID-19 within the last 14 days;
  • are waiting for a COVID-19 test result.

This application must be accompanied by a copy of two documents: one showing your name and date of birth and the other showing your name and domiciliary address. If you are domiciled or you lodged in a eligible health establishment, these documents may be replaced by an attestation from a staff member confirming your identity and place of residence.

VOTE BY MAIL

  1. If you are in one of the above-described situations, and you are entered on the list of electors, you can also vote by mail. To do this, you must make a verbal or written request to the returning officer no later than October 27, 2021.

If you are requesting to vote by mail because you must comply with an order or a recommendation from public health authorities to isolate, your request can only be made from October 17, 2021 and will be valid for the current poll only. If you are in situation other than those above, your application will be valid for the current poll and any recommenced proceedings arising from this election.

NOTICE is hereby given that the Town Council, at an ordinary meeting that will be held in the hall of the town hall, on Monday October 4, 2021, at 7h30 pm, will consider the request for minor exemption from the zoning By-Law 1156-11, presented by Mr Jean-François Côté, for a property situated at 1209, rue du Monument.

The nature and consequences of this exemption are the following:

  • the nature of the minor exemption is to increase of 40 m2 the area for a fishing building in accordance to the maximal area of 100 m2 required by the article 8.8.3 of the Zoning By-Law 1156-11;
  • the minor exemption will have for consequence to regularize the construction of a complimentary fishing building within an urban perimeter with an area of 140 m2.

By virtue of ministerial order 2020-049 dated July 4, 2020, any procedure other than a referendum which is part of the decision-making process of a municipal body and which involves the movement or gathering of citizens can be replace by a procedure with a 15-day written consultation announced beforehand by a public notice;

During the session of the municipal council, which was held on September 7, 2021, the latter authorized, by resolution 21-09-031, the consultation in writing of the persons interested with regard to the request for minor exemption mentioned above in the minutes of the advisory planning committee, adopted by the town council by the resolution 21-09-031;

The municipal council, during the ordinary meeting to be held behind in the hall of the town hall, Monday October 4, 2021, at 7:30 p.m., rule on this request for minor exemption;
