ENACTMENT OF BY-LAW

            NOTICE is hereby given that the Town Council, at its ordinary meeting held on February 4, 2019, has adopted the following By-Laws:

By-law 1385-19:

« Règlement remplaçant le règlement 1357-17 et créant un nouveau règlement pour imposer de nouveaux tarifs pour la collecte des déchets, l'entretien du lieu d'enfouissement technique, la gestion intégrée des déchets, la collecte  des matières recyclables, le transport de ces matières et leur traitement au centre de tri de Grande-Rivière, la collecte des matières organiques, le transport de ces matières et leur traitement au site de compostage de Chandler. »

By-law 1386-19:

« Règlement modifiant le règlement 970-06 relatif au traitement des personnes membres du comité consultatif d’urbanisme qui ne sont pas membres du conseil municipal en remplaçant l’article 5. »

NOTICE is also given that those By-Laws are deposited at the office of the municipality and that the interested may there take cognizance thereof during regular office hours.

ENACTMENT OF BY-LAW

PUBLIC NOTICE is hereby given :

  1. 1. THAT at a meeting held on December 3, 2018, the Town Council has adopted By-Law 1374-18 «décrétant une dépense d’une somme de 948 720 $ et un emprunt de 948 720 $ pour la conversion du système d’éclairage public de la ville à la technologie DEL».
  1. 2. THAT By-Law 1374-18 has been approved by the qualified voters during a register held on December 11 and 12, 2018.
  1. 3. THAT By-Law 1374-18 have been approved by the Minister of Municipal Affairs and Housing, on February 1, 2019.
  1. 4. THAT the interested can consult that By-Law at the Clerk’s office, at the Town Hall, 25, rue de l’Hôtel-de-Ville, during regular office hours.

MINOR EXEMPTION

FROM URBANISM BY-LAWS

NOTICE is hereby given that the Town Council, at an ordinary meeting that will be held on March 4, 2019, at 8 pm, will consider the request for minor exemption from the zoning By-Law 1156-11, presented by Mr Brent Simpson for the companie Motel Adams inc. for a property situated at 20, rue Adams.

The nature and consequences of this exemption are the following:

  • the nature of the minor exemption is to:

For the 97 and 97-A, Jacques-Cartier street :

  • reduce of 1,71 m the left lateral setback in accordance to the minimal left lateral setback of 2 m required at the article 4.6 of the Zoning By- Law no1156-11;
  • reduce of 3,11 m the rear setback in accordance to the minimal rear setback of 4 m required at the article 4.6 of the Zoning By-Law no1156-11;
  • reduce of 0,34 m the depth in accordance to the minimal depth of 28 m required at the article 5.3 of the land division By-Law 1157-11.

For the 20, Adams street :

  • reduce of 1,70 m the right lateral setback, face to the Jacques-Cartier street, in accordance to the minimal right lateral setback of 2 m required at the article 4.6 of the Zoning By-Law no1156-11;
  • reduce of 1,11 m of the left lateral setback, face to the Adams street, in accordance to the minimal left setback of 2 m required at the article 4.6 of the Zoning By-Law no1156-11;
  • the minor exemption will have for consequence to :
  • permit a principal building on a lot with a depth of 27,66 m, situated at 97 and 97-A, Jacques-Cartier street, with a left lateral setback of 0,29 m and a rear setback of 0,89 m.
  • permit a principal building, situated at 20, Adams street, with a right lateral setback of 0,29 m face to the Jacques-Cartier street and a left lateral setback of 0,89 m face the Adams street.

During this meeting, the Town Council will hear the interested wishing to be heard on that request.

MINOR EXEMPTION

FROM URBANISM BY-LAWS

NOTICE is hereby given that the Town Council, at an ordinary meeting that will be held on March 4, 2019, at 8 pm, will consider the request for minor exemption from the zoning By-Law 1156-11, presented by Mr John Sams for the lot 4 054 192, cadastre du Québec.

The nature and consequences of this exemption are the following:

  • the nature of the minor exemption is :
  • to increase of 20 m2 of the area for an isolated private garage in accordance to the maximal area of 100 m2 required by the article 8.8.2.2 of the Zoning By-Law no1156-11;
  • to increase of 0.5 m of the height for an isolated private garage in accordance to the maximal height of 6.5 m required by the article 8.8.2.2 of the By-Law no1156-11.
  • the minor exemption will have for consequence to regularize permit the construction of an isolated private garage with an area of 120 m2 and a height of 7 m.

During this meeting, the Town Council will hear the interested wishing to be heard on that request.

        By-law 1376-18:

        « Créant une réserve financière au profit de l’ensemble du territoire de la municipalité pour une somme de 90 000 $ en 2019. »

        By-law 1377-18:

        « Créant une réserve financière au profit du quartier numéro 1 pour une somme de 5 000 $ en 2019. »

        By-law 1378-18:

        « Créant une réserve financière au profit du quartier numéro 2 pour une somme de 11 000 $ en 2019. »

        By-law 1379-18:

        « Créant une réserve financière au profit du quartier numéro 3 pour une somme de 10 000 $ en 2019. »

        By-law 1380-18:

Second draft 1156-11-37 (adopted on January 24, 2019)

amending the zoning by-law

NOTICE is hereby given that, following the public consultation meeting which was held on January 24, 2019, the municipal Council of "Ville de Gaspé" has accepted by resolution, on January 24, 2019 a second draft of by-law 1156-11-37 amending the zoning by-law.  This second draft contains provisions that may be subject to an application made by interested persons from anyone of the zones to which such provisions apply and of the contiguous zones, to require that a by-law containing these be submitted for their approval, in accordance with the Act respecting elections and referendums in municipalities.

  1. 1. PURPOSE OF AN APPLICATION TO TAKE PART TO A REFERENDUM

         1.1     An application relating to the following provision of the second draft:

  • « Agrandissant la zone M-224 à même une partie de la zone M-236 »;

Such an application is required that the by-law containing the provision to which it applies be submitted for the approval of the qualified voters in the zone to which applies this application, and in any contiguous zone from which a valid application originates.

         1.2     An application relating to the following provision of the second draft:

  • « Modifiant le deuxième paragraphe de l’article 3.2.17 « CLASSE INDUSTRIE DIVERSE (I-2) », afin d’ajouter l’usage autorisé Industrie de production, de transformation et d’entreposage du cannabis (2131) dans la zone IC-269 »;

  • « Ajoutant une note 1 à la grille de spécifications de la zone IC-269 afin d’ajouter une disposition relative aux matériaux autorisés pour la construction d’une serre. »

  1. 3. VALIDITY OF AN APPLICATION

To be valid, an application to take part to a referendum must:

  • state clearly the provision of the second draft to which the application refers;
  • indicate the zone from which the application originates;
  • be signed by at least 12 interested persons of the zone from which it originates, if there are more than 21 interested persons in that zone, or, otherwise, by the majority of the interested persons;
  • be received by the Town clerk office at the town hall no later than February 6, 2019, 4:30 pm.
  1. 4. INTERESTED PERSONS WHO ARE ENTITLED TO SIGN AN APPLICATION

An interested person is a person of full age, Canadian citizen and not under curatorship who, on the date of adoption of the second draft, which is January 24, 2019, is not disqualified from voting and meets one of the following requirements:

  • is domiciled in a zone from which an application may originate and who has been domiciled in Québec for at least 6 months;
  • is the owner of an immovable or the occupant of a business place situated on such a zone since 12 months at least.
  1. LACK OF APPLICATIONS

Should there be no valid applications relating to the provisions of the second draft, the said provisions may be then included in a by-law which will not have to be submitted for the approval of the qualified voters.

  1. 6. CONSULTATION OF THE DRAFT

The second draft of by-law is available for consultation at the Clerk’s office at the Town Hall during regular work hours, that is from 8 h 15 am till 12 h and from 1 h till 4 h 30 pm, Monday till Thursday, and from 8 h 15 am till 12 h on Friday.

ENACTMENT OF BY-LAW

PUBLIC NOTICE is hereby given:

1.-     THAT at a meeting held on December 3, 2018, the Town Council has adopted the following by-laws:

         1156-11-35,    « règlement amendant le règlement de zonage 1156-11 en modifiant les usages autorisés dans la zone M-224 afin de permettre l’usage habitation multifamiliale et collective (H-8) avec un maximum de douze (12) logements »;

         1156-11-36,    « règlement modifiant les usages autorisés dans la zone CE-271 afin de permettre comme usage spécifiquement permis dans cette zone, l’usage Vente au détail de cannabis et de produits du cannabis (5990), modifiant le paragraphe B) COMMERCE DE DÉTAIL (DIVERS) de l’alinéa 2 de l’article 3.2.3 CLASSE DÉTAIL, ADMINISTRATION ET SERVICES (C-2) afin de modifier l’usage autorisé 599 – Autres activités de la vente au détail (sauf les sex-shops) et remplaçant le titre de l’article 22.12.4 Affichage dans une zone* où les classes d'usages* Accommodation (C-1), Détail, administration et services (C-2), Restauration (C-7), Débit de boisson (C-8) et Erotique (C-11) sont autorisées ».

2.-     THAT those by-laws 1156-11-35 and 1156-11-36 have been approved by the council of the regional county municipality La Côte-de-Gaspé, on December 12, 2018;

3.-     THAT an assessment of conformity has been issued by the Secretary-treasurer of the regional county municipality La Côte-de-Gaspé in respect of by-laws 1156-11-35 and 1156-11-36 on December 18, 2018;

4.-     THAT those by-laws 1156-11-35 and 1156-11-36 came into force on December 18, 2018, according to the Act respecting land use planning and development;

5.-     THAT the interested can consult this by-law at the Office of the Town clerk, at the Town Hall, 25, rue de l'Hôtel-de-Ville, Gaspé, during regular office hours.

NOTICE is hereby given that the municipal Council of "Ville de Gaspé", at its regular meeting held on December 17, 2018, has adopted by resolution the following draft of by-law and that a public consultation meeting will be held at the Town Hall, on Thursday, January 24, 2019, at 4:00 p.m.

Draft of by-law 1156-11-37:

         The draft of by-law amends the zoning by-law 1156-11, as follows:

NOTICE is hereby given that the Town Council, at an ordinary meeting that will be held on February 4, 2019, at 8 pm, will consider the request for minor exemption from the zoning By-Law 1156-11, presented by Mr Michel Desjardins, for a property situated at 232, rue Domagaya.

The nature and consequences of this exemption are the following:

  • the nature of the minor exemption is to :
  • reduce of 32 cm the left lateral setback for a shed in accordance to the minimal lateral back margin of 1.5 m required at the article 8.8.1 of the zoning By-Law 1156-11;
  • reduce of 38 cm the rear setback for a shed in accordance to the minimal rear setback of 1.50 m required at the article 8.8.1 of the zoning By-Law 1156-11.
  • the minor exemption will have for consequence to regularize the location of a shed with a left lateral setback of 1.18 m and a rear setback of 1.12 m.
