PUBLIC NOTICE is hereby given :

1.      THAT at a meeting held on February 4, 2016, the Town Council has adopted By-Law 1297-16 «décrétant une dépense d’une somme de 260 000 $ et un emprunt d’une somme de 59 000 $ pour la réalisation de travaux de réfection et d’empierrement du mur de la rue Dubé».

2.      THAT By-Law 1297-16 has been approved by the qualified voters during a register held on February 16, 2016.

3.      THAT By-Law 1297-16 have been approved by the Minister of Municipal affairs and Land occupancy, on April 19, 2017.

4.      THAT the interested can consult that By-Law at the Clerk’s office, at the Town Hall, 25, rue de l’Hôtel-de-Ville, during regular office hours.

NOTICE is hereby given that the Town Council, at an ordinary meeting that will be held on May 1st, 2017, at 8 pm, will consider the request for minor exemption from the zoning By-Law 1156-11, presented by Mister Steve Thibault for a property situated at 42, rue Pouliot.

The nature and consequences of this exemption are the following:

  • the nature of the minor exemption is :
  • to reduce of 82 cm of the minimal lateral back margin of 2 meters required at the HC-227 zone to the specification grid at the required at the article 8.7 of the zoning By-Law 1156-11;
  • to reduce of 1.29 cm of the sum of the lateral back margin required of 5 m at the specification grid of the HC-227 zone required at the article 8.7 of the zoning By-Law 1156-11.
  • the minor exemption will have for consequence to :
  • allow the construction of a private garage annexed to the residence which will be implanted at 1.18 m of the right lateral line;
  • conform the sum of the lateral margins to 3.71 m.

During this meeting, the Town Council will hear the interested wishing to be heard on that request.

NOTICE is hereby given that the Town Council, at an ordinary meeting that will be held on May 1st, 2017, at 8 pm, will consider the request for minor exemption from the zoning By-Law 1156-11, presented by Me Isabelle Simard for a property situated at 269 et 269-1, rue Jacques-Cartier.

The nature and consequences of this exemption are the following:

  • the nature of the minor exemption is to reduce of 25cm of the minimal lateral back margin of 1.5m required by the article 8.8.1 of the zoning By-Law 1156-11;
  • the minor exemption will have for consequence to regularize the derogatory layout of a garage with a right lateral back margin of 1.25 cm.

During this meeting, the Town Council will hear the interested wishing to be heard on that request.

ENACTMENT OF BY-LAW

PUBLIC NOTICE is hereby given :

1.      THAT at a meeting held on December 19, 2016, the Town Council has adopted By-Law 1324-16 «décrétant une dépense d’une somme de 1 090 000 $ et un emprunt de 194 125 $ pour la réalisation du projet Gaspé terre de rencontres».

2.      THAT By-Law 1324-16 has been approved by the qualified voters during a register held on January 10, 2017.

3.      THAT By-Law 1324-16 has been approved by the Minister of Municipal affairs and Land occupancy, on March 3, 2017.

4.      THAT the interested can consult those By-Laws at the Clerk’s office, at the Town Hall, 25, rue de l’Hôtel-de-Ville, during regular office hours.

AN APPLICATION TO TAKE PART TO A REFERENDUM

Second draft 1156-11-25 (adopted on March 6, 2017)

amending the zoning by-law

NOTICE is hereby given that, following the public consultation meeting which was held on March 6, 2017, the municipal Council of "Ville de Gaspé" has accepted by resolution, on March 6, 2017  a second draft of by-law 1156-11-25 amending the zoning by-law.  This second draft contains provisions that may be subject to an application made by interested persons from anyone of the zones to which such provisions apply and of the contiguous zones, to require that a by-law containing these be submitted for their approval, in accordance with the Act respecting elections and referendums in municipalities.

1.      PURPOSE OF AN APPLICATION TO TAKE PART TO A REFERENDUM

         An application relating to the following provision of the second draft :

  • « Modifiant les usages autorisés dans les zones AF-112 et AF-114 afin de permettre, comme usage spécifiquement permis dans cette zone, l’usage de carrière et sablière et afin d’assujettir cet usage au Règlement sur les usages conditionnels no 1172-12; »

Such an application is required that the by-law containing the provision to which it applies be submitted for the approval of the qualified voters in the zone to which applies this application, and in any contiguous zone from which a valid application originates.

         An application relating to the following provision of the second draft :

  • « Agrandissant la zone C-208 à même une partie de la zone P-210, et ce, afin d’inclure le lot 3 147 530, cadastre du Québec à la zone C-208. »

Such an application is required that the by-law containing the provision to which it applies be submitted for the approval of the qualified voters in the zone to which applies this application, and in any contiguous zone from which a valid application originates.

2.  LOCALIZATION OF THE CONCERNED ZONES

The concerned zone are illustrated on the following sketches :

3.      VALIDITY OF AN APPLICATION

To be valid, an application to take part to a referendum must:

  • state clearly the provision of the second draft to which the application refers;
  • indicate the zone from which the application originates;
  • be signed by at least 12 interested persons of the zone from which it originates, if there are more than 21 interested persons in that zone, or, otherwise, by the majority of the interested persons;
  • be received by the Town clerk office at the town hall no later than March 23, 2017, 4:30 pm.

4.      INTERESTED PERSONS WHO ARE ENTITLED TO SIGN AN APPLICATION

An interested person is a person of full age, Canadian citizen and not under curatorship who, on the date of adoption of the second draft, which is March 6, 2017, is not disqualified from voting and meets one of the following requirements:

  • is domiciled in a zone from which an application may originate and who has been domiciled in Québec for at least 6 months;
  • is the owner of an immovable  or the occupant of a business place situated on such a zone since 12 months at least.
  1. LACK OF APPLICATIONS

Should there be no valid applications relating to the provisions of the second draft, the said provisions may be then included in a by-law which will not have to be submitted for the approval of the qualified voters.

6.      CONSULTATION OF THE DRAFT

The second draft of by-law is available for consultation at the Clerk’s office at the Town Hall during regular work hours, that is from 8 h 15 am till 12 h and from 1 h till 4 h 30 pm, Monday till Thursday, and from 8 h 15 am till 12 h on Friday.

NOTICE is hereby given that the Town Council, at an ordinary meeting that will be held on Monday, March 20, 2017, at 8 pm, will consider the request for conditional use in accordance with the Conditional uses by-law 1172-12, presented for the property situated at 143-145, rue de la Reine.

The nature of this conditional uses are the following:

  • the acceptance of a residential use as a conditional use to the M-236 area, within a part of the building located at 143-145, rue de la Reine.

During this meeting, the Town Council will hear the interested wishing to be heard on that request.

NOTICE is hereby given that the Town Council, at an ordinary meeting that will be held on March 20, 2017, at 8 pm, will consider the request for minor exemption from the zoning By-Law 1156-11, presented by Madam Anne-Marie Julien for a property situated at 6, Douglas boulevard.

The nature and consequences of this exemption are the following:

  • the nature of the minor exemption is to reduce of 74 cm the minimal distance required by section 8.8.1 of the zoning By-Law 1156-11, or a minimum distance of at least 1.5 m from the side lines.
  • the minor exemption will have for consequence to regularize a shed that is located at 76 cm from the side line.

During this meeting, the Town Council will hear the interested wishing to be heard on that request.

PUBLIC NOTICE is hereby given by the undersigned, Clerk of Ville de Gaspé, that at an ordinary sitting held on February 20, 2017, the Town Council has adopted the following By-Law:

1328-17 : MODIFIANT LE RÈGLEMENT 1169-12, DÉCRÉTANT UN EMPRUNT ET UNE DÉPENSE D’UNE SOMME DE 7 735 000 $ POUR LA MISE AUX NORMES DES INSTALLATIONS DE PRODUCTION D’EAU POTABLE DU SECTEUR GASPÉ-CENTRE, POUR AUGMENTER DE 7 735 000 $ À 8 756 000 $ ET MODIFIER LES CLAUSES DE TAXATION, POUR AUGMENTER DE 7 735 000 $ À 8 756 000 $.

THAT the persons qualified to vote on the By-Law on the date of February 20, 2017, and who have therefore the right to demand that this By-Law be submitted to a referendum poll will have access to a register open for that purpose from nine (9) hours to nineteen (19) hours on March 8, 2017, at the office of the undersigned, at the Town Hall in order to enter their name, address and occupation together with their signature.

IS A QUALIFIED VOTER OF THE MUNICIPALITY

A person who, on February 20, 2017, is not disqualified from voting according to article 524 of the Act respecting elections and referendums in municipalities and meets the following requirements:

  • a natural person domiciled in the municipality and, since at least six months, in Québec and
  • is of full age and a Canadian citizen, and not under curatorship.

The non resident sole owner of an immoveable or non resident sole occupant of a business place situated in the municipality who is not disqualified from voting and meets the following requirements:

  • is the owner of an immoveable or sole occupant of a business place situated in the municipality since at least 12 months;
  • in the case of a natural person, be of full age and Canadian citizen and not under curatorship.

The non resident undivided co-owners and non resident co-occupants of a business place situated in the municipality not disqualified from voting and meet the following requirements:

  • is the undivided co-owner of an immoveable or co-occupant of a business place situated in the municipality since at least 12 months;
  • is designated by means of a power of attorney signed by a majority of the persons who are co-owners or co-occupants since at least 12 months, as the one who has the right to sing in their name and to be entered on the referendum list of the municipality. This power of attorney must be produced before or at the signature time.

Legal person:

  • have designated by resolution among its members, directors or employees, a person who, on February 20, 2017, and at voting time, is of full age and Canadian citizen, is not under  curatorship and is not disqualified to vote.

THAT the persons qualified to vote on the By-Law in question must establish their identity to the responsible person for the register, by presenting, among others: a health-insurance card issued by the Québec Health Insurance Board, a driver’s permit issued by the Québec Automobile Insurance Society, a Canadian passport, an identity card of the Canadian armed forces, a certificate of Indian status.

THAT the number of applications needed in order that a referendum poll be held for this By-Law is 470 and failing this number, the concerned By-Law will be deemed approved by the qualified voters.

THAT the qualified voters may examine this By-Law at the office of the undersigned from 8 h 15 am till 12 h and from 1 h till 4 h 30 pm from Monday till Thursday,  and from 8 h 15 am till 12 h on Friday, and during registration hours.

THAT the result of this registration procedure will be announced on March 8, 2017, at 7 pm, at the office of the undersigned, 25, rue de l’Hôtel-de-Ville in Gaspé.

1.-  THAT at a meeting held December 19, 2016, the Town Council has adopted by-law 1171-12-02 amending the by-law “1171-12 règlement relatif au plan d’implantation et d’intégration architecturale 1171-12 , en modifiant l’article 4.2 PROJET D’HÉBERGEMENT D’ENVERGURE ET D’HABITATION MULTIFAMILIALE DE DOUZE (12) LOGEMENTS ET PLUS afin d’enlever du sous-article 4..1 DOMAINE D’APPLICATION les exceptions suivantes : habitations collectives ou habitation à loyer modique, maison pour personnes en difficultés et maison de retraite et orphelinat »;

2.-  THAT by-law 1171-12-02 has been approved by the council of the regional county municipality La Côte-de-Gaspé, on February 8, 2017;

3.-  THAT assessments of conformity have been issued by the Secretary-treasurer of the regional county municipality La Côte-de-Gaspé in respect of by-laws 1171-12-02 on February 13, 2017;

4.-  THAT by-law 1171-12-02 came into force on February 13, 2017, according to the Act respecting land use planning and development;

5.-  THAT the interested can consult this by-law at the Town clerk’s office, at the Town Hall, 25, rue de l'Hôtel-de-Ville, Gaspé, during regular office hours.
