WRITTEN CONSULTATION REGARDING A PROJECT OF BY-LAW

NOTICE is hereby given that the municipal Council of "Ville de Gaspé", at its regular meeting held on November 16, 2020, has adopted by resolution the following draft of by-law.

First draft of by-law 1156-11-48 :

The draft of by-law amends the zoning by-law 1156-11, as follows:

  • « modifiant les usages autorisés dans la zone IC-269 afin de permettre comme usage spécifiquement permis dans cette zone, l’usage Entreposage de produits finis de composantes d’éolienne accompagné d’un bâtiment principal. »

The area is located in the Augustines’s industrial park, and illustrated on the following sketch:

This by-law contains provisions specific to a by-law subject to referendum approval.

The written consultation with regard to this draft by-law was determined by the municipal council in accordance with resolution 20-11-047 adopted at its ordinary meeting of November 16, 2020. Thus, in accordance ministerial order number 2020-049 of the Minister of Health and Social Services dated July 4, 2020, any procedure which involves the movement or assembly of citizens, which is part of the decision-making process of the municipal council, can be replaced by a written consultation announced 15 days beforehand by public notice.

A written consultation on this draft by-law 1156-11-48 will therefore take place from November 19, 2020 to December 4, 2020. Anyone interested can send their comments in writing to the legal services and town clerk office at the following email address: isabelle.vezina@ville.gaspe.qc.ca

Consequently, after holding this written consultation, the municipal council will take note of the written comments received and may adopt a second draft by-law. This second draft regulation may take into account written comments received during this written consultation period.

The explanation of this draft regulation is presented in the document below and the project of by-law is joint to this public notice.

ATTENDU QUE la Ville de Gaspé a adopté le Règlement de zonage no 1156-11 dont font partie un plan de zonage et des grilles de « spécifications »;

ATTENDU QUE la Ville de Gaspé est régie par la Loi sur l’aménagement et l’urbanisme (L.R.Q., ch. A-19.1) et que le Règlement no 1156-11 ne peut être modifié que conformément aux dispositions de cette loi;

ATTENDU QUE suivant les directives de l’Arrêté ministériel numéro 2020-049 le ministre de la Santé et des Services sociaux du 4 juillet 2020 émis dans le cadre de la pandémie du coronavirus (COVID-19) qui stipule que toute procédure autre que référendaire qui fait partie du processus décisionnel d’un organisme municipal et qui implique le déplacement ou le rassemblement de citoyens doit être suspendue ou remplacée, l’assemblée publique de consultation sur le projet de règlement 1156-11-48 a été remplacée par une procédure de consultation écrite qui s’est tenue du

MINOR EXEMPTION FROM URBANISM BY-LAWS

NOTICE is hereby given that the Town Council, at an ordinary meeting that will be held behind closed doors via technological mean of communication, on Monday December 7, 2020, at 7h30 pm, will consider the request for minor exemption from the zoning By-Law 1156-11, presented by Me Isabelle Simard, for a property situated at 245, rue Domagaya.

The nature and consequences of this exemption are the following:

  • the nature of the minor exemption is to reduce of 3.86 m the secondary front back margin in accordance to the minimal secondary front back margin of 5 m required at the article 2.5.2 and the specifications grid of the HC-257 zone of Zoning By-Law 1156-11;
  • the minor exemption will have for consequence to regularize the implantation of a building with a secondary front back margin of 1.14 m.

Act respecting land use and development provides that any interested party may be heard by the municipal council when the latter must rule on a request for a minor exemption, but that currently, under ministerial order 2020-029 dated from April 26, 2020, the meetings of the municipal council can be held exceptionally behind closed doors during the state of health emergency;

By virtue of ministerial order 2020-049 dated July 4, 2020, any procedure other than a referendum which is part of the decision-making process of a municipal body and which involves the movement or gathering of citizens can be suspended if the council decides to replace the procedure with a 15 days written consultation announced beforehand by a public notice;

During the session of the municipal council which was held behind closed doors via technological mean of communication on November 16, 2020, the latter authorized, by resolution 20-11-048, the consultation in writing of the persons interested with regard to the request for minor exemption mentioned above in the minutes of the advisory planning committee, adopted by the town council by the resolution 20-11-063;

The municipal council, during the ordinary meeting to be held behind closed doors, via technological means of communication, Monday December 7, 2020, at 7:30 p.m., rule on this request for minor exemption;

MINOR EXEMPTION FROM URBANISM BY-LAWS

NOTICE is hereby given that the Town Council, at an ordinary meeting that will be held behind closed doors via technological mean of communication, on Monday December 7, 2020, at 7h30 pm, will consider the request for minor exemption from the zoning By-Law 1156-11, presented by Mrs Myranie Lemieux-Fournier, for a property situated at 853, montée de Pointe-Navarre;

The nature and consequences of this exemption are the following:

  • the nature of the minor exemption is to :
  • increase of 69.5% the expansion percentage for a non-conforming service station use compared to the 0% expansion percentage required in the article 25.1.4.1 of Zoning By-law no 1156 11;
  • the reduction of 4.8 m of the front setback compared to the minimum front setback of 9 m required in the specification grid for zone PA-144 of Zoning By-law no 1156 11;
  • the reduction of 2.68 m of the minimum free space between the pump island shelter and the front line compared to the required minimum free space of 3 m required in the article 13.4 of Zoning By-law no. 1156 11;
  • the minor exemption will have for consequence to :
  • allow the expansion of the existing service station by 131.8 m², representing a percentage expansion of 69.5%, and having a front setback of 4.2 m;
  • conform the pump island shelter with a free space of 0.32 m between the pump island shelter and the front line.

The nature and consequences of this exemption are the following:

  • the nature of the minor exemption is to reduce of 0.28 m the width of a building lot in accordance to the minimal width of 7 m required at the article 5.3 A) 1 of the land division By-Law 1157-11.
  • the minor exemption will have for consequence to regularize the subdivision of lots 5 202 244 and 5 202 245, cadastre of Québec, to create 3 buildings lots with one lot with a width of 6,72 m.

ENACTMENT OF BY-LAWS

            NOTICE is hereby given that the Town Council, at its ordinary meeting held on November 2, 2020, has adopted the following By-Laws:

By-law 1425-20 :

« Règlement modifiant le règlement 147-78 afin de modifier un nom de rue (rue de Tar Point par chemin Maher). »

By-law 1426-20 :

« Règlement modifiant les articles 14 et 15 du règlement 1413-20 décrétant l’adoption d’un programme d’aide sous forme de crédit de taxes pour promouvoir la construction de logements locatifs sur le territoire de la ville de Gaspé. »

PUBLIC NOTICE is hereby given by the undersigned, Clerk of Ville de Gaspé, that at a regular sitting held in camera by videoconference on November 2, 2020, the Town Council has adopted the following By-Law:

1424-20 : RÈGLEMENT DÉCRÉTANT L’ACQUISITION DE VÉHICULES ET UN EMPRUNT DE 560 000 $

THAT by virtue of decree 2020-033 of May 7, 2020, taken in the context of the health emergency declaration ordered by the government, any procedure for the registration of qualified voters applied under Chapter IV of Title II of the Act respecting elections and referendums in municipalities can be replaced by a procedure for receiving written requests for a 15-day referendum poll.

THAT the persons qualified to vote on this By-Law on the date of November 2, 2020, and who have therefore the right to demand that this By-Law be submitted to a referendum poll.  A demand must be done by writing and have the followings informations:

  • The By-law number or the By-law title who’s in the object of the demand;
  • The name, address and the capacity of the person qualified to vote, and with their signature.

It is possible to make a demand for a referendum poll by using the available form following this public notice.

This request must be accompanied with a copy of one of those following identity pieces : a health-insurance card issued by the Québec Health Insurance Board, a driver’s permit or a temporary permit issued by the Québec Automobile Insurance Society, a Canadian passport, an identity card of the Canadian armed forces, a certificate of Indian status.

In the case that the name of the person is not on the list of the qualified voters entitled to have their name entered on the referendum list of the entire municipality, the request must also be accompanied by a document attesting to his right to be registered there.

All person who assist another person qualified to vote who’s unable to sign by-herself the demand must register:

  • His name;
  • his relationship with the person qualified to vote (spouse, parent or other);
  • if the person entitled to vote is neither a parent nor a spouse, a written declaration that he did not assist another person who is not a parent or a spouse during the procedure referendum poll request;
  • a statement that she assisted the person qualified to vote;
  • his signature;

THAT the number of applications needed in order that a referendum poll be held for this By-Law is 1 211 and failing this number, the concerned By-Law will be deemed approved by the qualified voters.

THAT the result of this registration procedure will be publish at 9 am, on November 23, 2020 on the website of the city of Gaspé under the section of public notices.

IS A QUALIFIED VOTER OF THE MUNICIPALITY

A person who, on November 2, 2020, is not disqualified from voting according to article 524 of the Act respecting elections and referendums in municipalities and meets the following requirements:

  • a natural person domiciled in the municipality and, since at least six months, in Québec and
  • is of full age and a Canadian citizen, and not under curatorship.

The non resident sole owner of an immoveable or non resident sole occupant of a business place situated in the municipality who is not disqualified from voting and meets the following requirements:

  • is the owner of an immoveable or sole occupant of a business place situated in the municipality since at least 12 months;
  • in the case of a natural person, be of full age and Canadian citizen and not under curatorship.

The non resident undivided co-owners and non resident co-occupants of a business place situated in the municipality not disqualified from voting and meet the following requirements:

  • is the undivided co-owner of an immoveable or co-occupant of a business place situated in the municipality since at least 12 months;
  • is designated by means of a power of attorney signed by a majority of the persons who are co-owners or co-occupants since at least 12 months, as the one who has the right to sing in their name and to be entered on the referendum list of the municipality. This power of attorney must be produced before or at the signature time.

Legal person:

  • have designated by resolution among its members, directors or employees, a person who, on November 2, 2020, and at voting time, is of full age and Canadian citizen, is not under curatorship and is not disqualified to vote.

amending the zoning by-law

NOTICE is hereby given that, following the writtin consultation which was held from October 15 to October 30, 2020, the municipal Council of "Ville de Gaspé" has accepted by resolution, on November 2, 2020 a second draft of by-law 1156-11-47 amending the zoning by-law.  This second draft contains provisions that may be subject to an application made by interested persons from anyone of the zones to which such provisions apply and of the contiguous zones, to require that a by-law containing these be submitted for their approval, in accordance with the Act respecting elections and referendums in municipalities.

1.      PURPOSE OF AN APPLICATION TO TAKE PART TO A REFERENDUM

         An application relating to the following provision of the second draft:

  • Modifiant les usages autorisés dans la zone CE-271 afin de permettre comme usage spécifiquement permis l’usage Vente au détail de motocyclettes, de motoneiges et leurs accessoires (5594);

Such an application is required that the by-law containing the provision to which it applies be submitted for the approval of the qualified voters in the zone to which applies this application, and in any contiguous zone from which a valid application originates. However any contiguous zone who has made an application will participate at the referendum approval only if the application also originates of the zone to which it is contiguous.

  • Modifiant les usages autorisés dans la zone CE-271 afin de permettre la location et la réparation de motocyclettes, de motoneiges et leurs accessoires en usage complémentaire à l’usage 5594;

Such an application is required that the by-law containing the provision to which it applies be submitted for the approval of the qualified voters in the zone to which applies this application, and in any contiguous zone from which a valid application originates. However any contiguous zone who has made an application will participate at the referendum approval only if the application also originates of the zone to which it is contiguous.

2.      LOCALIZATION OF THE CONCERNED ZONES

This area is located northeast of boulevard de York Sud, between lots 4 055 391 and 4 055 414, cadastre of Québec, next to Super C (327, boulevard de York Sud) and is illustrated on the following sketch:

3.      VALIDITY OF AN APPLICATION

To be valid, an application to take part to a referendum must:

  • state clearly the provision of the second draft to which the application refers;
  • indicate the zone from which the application originates;
  • be signed by at least 12 interested persons of the zone from which it originates, if there are more than 21 interested persons in that zone, or, otherwise, by the majority of the interested persons;
  • be received by the Town clerk office at the town hall no later than November 13, 2020, 4:30 pm.

Given the current circumstances and in compliance with the guidelines for social distancing, the City replaces the usual procedure for the transmission of a form with that of the written request by inviting interested persons to individually forward a request to the director of legal services and town clerk at the following email address: greffe@ville.gaspe.qc.ca. This request must also contain a copy of the applicant's ID.

4.      INTERESTED PERSONS WHO ARE ENTITLED TO SIGN AN APPLICATION

An interested person is a person of full age, Canadian citizen and not under curatorship who, on the date of adoption of the second draft, which is November 2, 2020, is not disqualified from voting and meets one of the following requirements:

  • is domiciled in a zone from which an application may originate and who has been domiciled in Québec for at least 6 months;
  • is the owner of an immovable or the occupant of a business place situated on such a zone since 12 months at least.
  • LACK OF APPLICATIONS

Should there be no valid applications relating to the provisions of the second draft, the said provisions may be then included in a by-law which will not have to be submitted for the approval of the qualified voters.

6.      CONSULTATION OF THE DRAFT

The second draft of by-law is available, in French, for consultation in the document also attached to this notice.

NOTICE is hereby given that the municipal Council of "Ville de Gaspé", at its regular meeting held on October 13, 2020, has adopted by resolution the following draft of by-law.

First draft of by-law 1156-11-47 :

         The draft of by-law amends the zoning by-law 1156-11, as follows:

  • « Modifiant les usages autorisés dans la zone CE-271 afin de permettre comme usage spécifiquement permis l’usage Vente au détail de motocyclettes, de motoneiges et leurs accessoires (5594);
  • Modifiant les usages autorisés dans la zone CE-271 afin de permettre la location et la réparation de motocyclettes, de motoneiges et leurs accessoires en usage complémentaire à l’usage 5594;»

The purpose of this draft by-law is to permit as retail sell of motorcycle, snowmobile and their accessories as permitted use and the location and the reparation of motorcycle, snowmobile and their accessories as complementary use.

This area is located northeast of boulevard de York Sud, between lots 4 055 391 and 4 055 414, cadastre of Québec, next to Super C (327, boulevard de York Sud) and is illustrated on the following sketch:

This by-law applies to all areas of the city and contains provisions specific to a by-law subject to referendum approval.

The written consultation with regard to this draft by-law was determined by the municipal council in accordance with resolution 20-10-019 adopted at its ordinary meeting of October 13, 2020. Thus, in accordance ministerial order number 2020-049 of the Minister of Health and Social Services dated July 4, 2020, any procedure which involves the movement or assembly of citizens, which is part of the decision-making process of the municipal council, can be replaced by a written consultation announced 15 days beforehand by public notice.

A written consultation on this draft by-law 1156-11-47 will therefore take place from October 15, 2020 to October 30, 2020. Anyone interested can send their comments in writing to the legal services and town clerk office at the following email address: isabelle.vezina@ville.gaspe.qc.ca

Consequently, after holding this written consultation, the municipal council will take note of the written comments received and may adopt a second draft by-law. This second draft regulation may take into account written comments received during this written consultation period.

ATTENDU QUE la Ville de Gaspé a adopté le Règlement de zonage no 1156-11 dont font partie un plan de zonage et des grilles de « spécifications »;

ATTENDU QUE la Ville de Gaspé est régie par la Loi sur l’aménagement et l’urbanisme (L.R.Q., ch. A-19.1) et que le Règlement no 1156-11 ne peut être modifié que conformément aux dispositions de cette loi;

ATTENDU QUE suivant les directives de l’Arrêté ministériel numéro 2020-049 le ministre de la Santé et des Services sociaux du 4 juillet 2020 émis dans le cadre de la pandémie du coronavirus (COVID-19) qui stipule que toute procédure autre que référendaire qui fait partie du processus décisionnel d’un organisme municipal et qui implique le déplacement ou le rassemblement de citoyens doit être suspendue ou remplacée, l’assemblée publique de consultation sur le projet de règlement 1156-11-47 a été remplacée par une procédure de consultation écrite qui s’est tenue du     2020 au     2020;

ATTENDU QUE ce règlement contient des dispositions pouvant faire l’objet d’une demande de la part des personnes intéressées afin qu’elle soit soumis à leur approbation conformément à la Loi sur les élections et les référendums dans les municipalités (L.R.Q., c. E-2.2);

ATTENDU QU’un avis public aux personnes intéressées ayant le droit de signer une demande de participation à un référendum a été publié sur le site internet de la ville de Gaspé, le

QU’un règlement de ce conseil, portant le numéro 1156-11-47, soit et est adopté et qu’il soit statué et décrété ce qui suit, à savoir :

ARTICLE 1 :   Le Règlement de zonage no 1156-11 est amendé en :

  • modifiant les usages autorisés dans la zone CE-271 afin de permettre comme usage spécifiquement permis l’usage Vente au détail de motocyclettes, de motoneiges et leurs accessoires (5594);

Le tout tel qu’indiqué à la grille de spécifications, laquelle est jointe au présent règlement comme annexe « A ».

ARTICLE 2 :   Le Règlement de zonage no 1156-11 est amendé en :

  • modifiant les usages autorisés dans la zone CE-271 afin de permettre la location et la réparation de motocyclettes, de motoneiges et leurs accessoires en usage complémentaire à l’usage 5594;

Le tout tel qu’indiqué à la grille de spécifications, laquelle est jointe au présent règlement comme annexe « A ».

ARTICLE 3 :   La grille de spécifications jointe au présent règlement comme annexe «A» fait partie intégrante de ce règlement comme si elle était ici au long reproduite.

ARTICLE 4 :   Le présent règlement ainsi que son annexe « A » fait partie intégrante du règlement de zonage qu’ils modifient.

ARTICLE 5 :   Le présent règlement entre en vigueur conformément à la loi.

NOTICE is hereby given that the Town Council, at an ordinary meeting that will be held behind closed doors in the hall of the town hall, on Monday November 2, 2020, at 7h30 pm, will consider the request for minor exemption from the zoning By-Law 1156-11, presented by Mrs Marie-Andrée Laflamme, for a property situated at 129-131, rue de la Reine.

The nature and consequences of this exemption are the following:

  • the nature of the minor exemption is to increase of 1.7 m the height of a retaining wall in accordance to the maximal height of 2 m required at the article 24.9 of the Zoning By-Law 1156-11;
  • the minor exemption will have for consequence to regularize the construction of a retaining wall with a height of 3.7 m.

Written consultation

Act respecting land use and development provides that any interested party may be heard by the municipal council when the latter must rule on a request for a minor exemption, but that currently, under ministerial order 2020-029 dated from April 26, 2020, the meetings of the municipal council can be held exceptionally behind closed doors during the state of health emergency;

By virtue of ministerial order 2020-049 dated July 4, 2020, any procedure other than a referendum which is part of the decision-making process of a municipal body and which involves the movement or gathering of citizens can be suspended if the council decides to replace the procedure with a 15-day written consultation announced beforehand by a public notice;

During the session of the municipal council which was held behind closed doors on October 13, 2020, the latter authorized, by resolution 20-10-016, the consultation in writing of the persons interested with regard to the request for minor exemption mentioned above in the minutes of the advisory planning committee, adopted by the town council by the resolution 20-10-038;

The municipal council, during the ordinary meeting to be held behind closed doors, in the hall of the town hall, Monday November 2, 2020, at 7:30 p.m., and broadcasted, via technological means of communication, rule on this request for minor exemption;

Anyone interested in this minor exemption request may be heard by sending their comments in writing before October 30, 2020, 4:30 p.m., by email to the following address: isabelle.vezina@ville.gaspe.qc.ca. They will be transmitted to the municipal council before it decides on the request.
